Biên bản xác nhận miễn trừ trách nhiệm

Việc đăng ký tham gia Sự kiện đã thể hiện sự chấp thuận của bạn, đồng thời bạn đã hiểu, đồng ý và đảm bảo tuân thủ các điều khoản được quy định tại trang: https://www.marathonhn.com và trong phạm vi hệ thống đăng kí trực tuyến, không phụ thuộc vào việc bạn kí vào bản cam kết này hay không. 

Những điều khoản và quy định này được bổ sung cho các điều khoản và quy định tại trang đăng kí của Sự kiện.

Tôi đã đọc, hiểu, đồng ý và tự nguyện tuân thủ những nội dung sau đây:  

1. Tôi sẽ tham khảo toàn bộ các tài liệu về Sự kiện, hoàn tất đăng kí và đồng ý về các thông tin, tài liệu và quy trình, và tuân thủ toàn bộ luật thi đấu và quy định của Đơn vị tổ chức. Tôi đồng ý rằng trước khi tham gia Sự kiện tôi sẽ khảo sát đường đua, cơ sở vật chất, trang thiết bị, và những khu vực được sử dụng, và nếu tôi nhận thấy rằng có bất kỳ điều gì không an toàn, tôi sẽ thông báo tới Đơn vị tổ chức ngay lập tức.
2. Việc tham gia Sự kiện của tôi dựa trên quyết định của Đơn vị tổ chức sau khi xem xét toàn bộ thông tin và đơn đăng kí, bao gồm biên bản xác nhận miễn trừ trách nhiệm này.
3. Tôi thừa nhận và đồng ý rằng tôi có trách nhiệm xác định tôi có đủ sức khỏe để tham gia Sự kiện một cách an toàn, tôi chứng thực và xác nhận rằng tôi đang hoặc sẽ có đủ sức khỏe và thể chất bằng cách luyện tập để tham gia Sự kiện mà tôi đăng ký.
4. Đơn vị tổ chức kí kết hợp đồng với các bên độc lập (cá nhân hoặc pháp nhân) nhằm cung cấp các dịch vụ và/hoặc thực hiện các hoạt động liên quan tới Sự kiện. Tôi hiểu rằng Đơn vị tổ chức không quản lý hay kiểm soát các đơn vị này. Tôi hiểu và chấp nhận việc các hoạt động của Sự kiện diễn ra trên cơ sở vật chất không thuộc sở hữu của Đơn vị tổ chức. 
5. Các thông tin được cung cấp trong biên bản xác nhận miễn trừ trách nhiệm này không đầy đủ, thực tế luôn tồn tại các hoạt động và rủi ro không thể lường trước mà Đơn vị tổ chức không thể đảm bảo tuyệt đối an toàn cũng như loại trừ tất cả các rủi ro. Tuy nhiên Đại diện của Đơn vị tổ chức luôn nỗ lực hỗ trợ nếu như tôi có các câu hỏi liên quan đến các hoạt động và rủi ro liên quan.
6. Tôi sẽ tôn trọng các quyền và giá trị của mỗi cá nhân tại Sự kiện bao gồm nhưng không giới hạn vận động viên, tình nguyện viên và trọng tài. Tôi sẽ luôn hành động một cách chuyên nghiệp và trách nhiệm, đảm bảo tiêu chuẩn cao, tôn trọng ngôn ngữ và hành động của mình, và không thực hiện bất kỳ hành vi phân biệt đối xử nào đối với các cá nhân có sự khác nhau về giới tính, tính cách, dân tộc, tôn giáo, khả năng,…;
7. Tôi đồng thời cũng lường trước về bất kỳ và tất cả các rủi ro và các mối nguy hiểm có liên quan đến việc tham gia Sự kiện, bao gồm nhưng không giới hạn các rủi ro về tài sản, tính mạng, sức khỏe mà tôi có thể gặp phải trong quá trình tham gia Sự kiện. Tôi đồng ý tham gia Sự kiện và chịu mọi trách nhiệm cho mọi rủi ro có thể xảy ra với tôi về việc tham dự Sự kiện này.
8. Về quan hệ của tôi với Đơn vị tổ chức, tôi đồng ý rằng trong trường hợp có sự mâu thuẫn giữa các đơn, hợp đồng hoặc bất kỳ tài liệu nào được ký kết giữa tôi và Đơn vị tổ chức và biên bản xác nhận miễn trừ trách nhiệm này thì biên bản miễn trừ trách nhiệm này sẽ được ưu tiên áp dụng.
9. Tôi đồng ý được tiếp nhận chăm sóc và điều trị y tế trong các trường hợp cần thiết theo hướng dẫn của Đơn vị tổ chức trong trường hợp tôi bị thương, tai nạn hoặc bệnh tật trong khi tôi tham gia Sự Kiện. Nếu cần thiết, tôi ủy quyền cho Đơn vị tổ chức hoặc bất kỳ đại lý, nhân viên, tình nguyện viên, chi nhánh và người được chỉ định để thay mặt tôi đồng ý với việc chăm sóc và điều trị y tế. Tôi hiểu rõ rằng việc ủy quyền này được đưa ra dựa vào các chẩn đoán y tế theo tình hình sức khỏe của tôi. Và việc được ủy quyền và quyền đưa ra cách chăm sóc thỏa đáng nhất đối với tôi sẽ hoàn toàn dựa trên phán xét của các đơn vị y tế tiếp nhận điều trị và chăm sóc cho tôi. Tôi đồng ý chịu trách nhiệm và lường trước nghĩa vụ chi trả cho bất kỳ và tất cả chi phí phát sinh từ việc tham gia Sự Kiện của tôi, bao gồm nhưng không giới hạn các chi phí chăm sóc và điều trị y tế, dịch vụ xe cấp cứu, viện phí, dịch vụ bác sĩ và thuốc điều trị. Tôi đồng ý chi trả và đảm bảo cho các bên liên quan khỏi mọi trách nhiệm liên quan tới các chi phí đó. Tôi cũng đồng ý tiếp nhận sơ cứu và được chăm sóc ngay lập tức từ các thành viên của Đơn vị tổ chức, nhân viên cuộc đua, hoặc tình nguyện viên trong lúc chờ điều trị từ bộ phận y tế được chỉ định.
10. Đơn vị tổ chức, tại bất kì thời điểm nào, có toàn bộ quyền loại các vận động viên khỏi cuộc thi, từ chối nhận đơn đăng kí, và đưa ra các điều khoản đặc biệt. Nếu tôi bị loại hoặc rời khỏi cuộc thi bất cứ lúc nào, tôi đồng ý sẽ chịu trách nhiệm cho toàn bộ chi phí khi bị loại khỏi cuộc thi với bất kì lý do nào, lý do về sức khỏe, bị loại, hay các tình huống khẩn cấp liên quan đến cá nhân. Nếu đơn đăng kí của tôi bị từ chối hoặc loại bỏ, tôi đồng ý rằng Đơn vị tổ chức sẽ không chịu trách nhiệm đối với các chi phí phát sinh hoặc thiệt hại với tôi và gia đình ngoài phạm vi đăng kí của cuộc thi. Trong trường hợp Đơn vị tổ chức từ chối hoặc loại tôi khỏi Sự kiện, Đơn vị tổ chức sẽ không hoàn trả bất kì chi phí tham dự nào nếu tôi đã cung cấp những thông tin không chính xác về điều kiện để tham gia Sự kiện vào thời điểm đăng kí và/hoặc tôi đã vi phạm bất kì điều khoản liên quan nào trong biên bản xác nhận miễn trừ trách nhiệm này. Nếu tôi muốn rút khỏi bất kỳ sự kiện nào của Đơn vị tổ chức, tôi phải tuân thủ hướng dẫn cụ thể về việc rút khỏi cuộc thi được thông báo trên trang https://www.marathonhn.com. 
11. Đơn vị tổ chức có thể đơn phương tạm hoãn, sửa đổi, hay hủy bỏ Sự kiện vì bất kỳ lý do nào, bao gồm việc các điều kiện về cuộc thi không đảm bảo an toàn. Trong trường hợp Sự kiện được tạm hoãn, sửa đổi hay hủy bỏ bởi các lý do bất khả kháng bao gồm nhưng không giới hạn: gió, mưa, mưa đá, bão, lốc xoáy, động đất, lũ lụt, dịch bệnh (bao gồm nhưng không giới hạn dịch Covid-19), các hoạt động khủng bố, hỏa hoạn, sự đe dọa hay tấn công, tai nạn trên đường đua, tổn thất không thể tránh khỏi, hoặc bất kì nguyên nhân nào khác ngoài sự kiểm soát của Đơn vị tổ chức, tôi sẽ không được hoàn phí đăng kí hay các chi phí nào liên quan đến cuộc thi.  
12. Tôi hiểu và đồng ý rằng bảo hiểm bắt buộc được áp dụng có hiệu lực cho tôi trong Sự kiện này, hay bất kì sự kiện nào của Đơn vị tổ chứctrong tương lai sẽ có thể không chi trả cho các chấn thương cá nhân, mất mát hoặc hủy hoại gây ra bởi tôi. 
13. Đơn đăng kí tham dự của tôi sẽ không được chuyển sang cho người khác hay các đơn vị khác. Việc chuyển hay cho phép người khác tham dự dưới tên của tôi sẽ dẫn đến việc hủy bỏ đăng kí không hoàn lại, bảo hiểm bị coi là vô hiệu hóa và bị truất quyền tham gia vào các sự kiện của Đơn vị tổ chức.
14. Tôi cho phép Đơn vị tổ chức và các bộ phận liên quan quyền chụp ảnh, quay phim, ghi âm và/hoặc sử dụng dưới bất kỳ hình thức nào về thông tin của tôi bao gồm nhưng không giới hạn: tên, hình ảnh, giọng nói, văn bản thông báo, … và không phải trả bất kỳ chi phí nào trong việc sử dụng cho mục đích truyền thông Sự kiện bao gồm nhưng không giới hạn các chương trình phát sóng, các ấn phẩm, podcast, sách quảng cáo, đĩa CD, DVD, các trang, nền tảng truyền thông xã hội, truyền hình hay các tài liệu thương mại, thông tin, giáo dục, hoặc quảng cáo liên quan nào. Tôi hiểu rằng tất cả quyền sở hữu và quyền bản quyền của các thông tin đã nêu tại điều khoản này sẽ do Đơn vị tổ chứcsở hữu và tôi từ bỏ bất kỳ quyền kiểm tra hoặc chấp thuận nào liên quan tới những thông tin này. Tôi hiểu và đồng ý rằng tên, số bib và kết quả cuộc đua của tôi sẽ được công khai trong và sau Sự kiện. 
15. Tôi đồng ý rằng, tên tôi và các thông tin liên lạc của tôi sẽ được đưa vào cơ sở dữ liệu của Sự kiện. Tôi đồng ý để hình ảnh và thông tin mình xuất hiện ở các ấn phẩm có liên quan đến Đơn vị tổ chức bao gồm nhưng không giới hạn bản tin hàng tháng và các tài liệu quảng cáo khác về các sự kiện sắp tới. 
16. Tôi đồng ý rằng nếu tôi lựa chọn không xuất hiện trong hệ thống dữ liệu của Đơn vị tổ chức, tôi sẽ vẫn nhận bản tin liên quan đến Sự kiện mà tôi đã đăng kí tham dự. Tôi cũng đồng ý rằng trách nhiệm của tôi là cập nhật các thông tin từ trang marathonhn.com (nếu có).
17. Đơn vị tổ chức có quyền chuyển nhượng đơn đăng ký này và những tài liệu có liên quan cho một tổ chức và/hoặc cá nhân khác (“Bên nhận chuyển nhượng”) và Bên nhận chuyển nhượng cũng sẽ được cấp các quyền, nghĩa vụ và biện pháp bảo vệ được quy định trong biên bản xác nhận miễn trừ trách nhiệm này. 
18. Tôi hoàn toàn chịu trách nhiệm cho sự an toàn của tài sản cá nhân tại Sự kiện và Đơn vị tổ chức sẽ không chịu trách nhiệm cho bất cứ sự mất mát hoặc hư hỏng nào liên quan tới tài sản cá nhân của tôi trong quá trình tham gia Sự kiện.
19. Đơn vị tổ chức thực hiện Sự kiện dưới sự điều chỉnh của pháp luật Việt Nam, và Đơn vị tổ chức được loại trừ các nghĩa vụ pháp lý liên quan đến tử vong, thương tật về thể chất hoặc tinh thần (bao gồm nhưng không giới hạn việc chấn thương tái phát và/hoặc chấn thương trầm trọng hơn) hay các tình trạng liên quan tới bệnh tật của tôi và các hành vi có thể gây hại tới tôi và cộng đồng.
20. Đơn vị tổ chức sẽ không chịu trách nhiệm với những vấn đề liên quan đến các sản phẩm, dịch vụ, thực phẩm, đồ uống được bày bán, phục vụ tại Làng Marathon.
21. Tôi hiểu và đồng ý rằng Đơn vị tổ chức đã áp dụng các biện pháp nâng cao về sức khỏe và an toàn bởi khả năng lây lan của COVID-19. Tôi phải làm theo tất cả các hướng dẫn khi đến thăm bất kỳ địa điểm nào liên quan đến Sự kiện và tự nguyện chịu mọi rủi ro liên quan đến việc tiếp xúc hoặc có nguy cơ lây nhiễm đối với COVID-19.
22. Tất cả các mâu thuẫn hay đơn kiện có thể nảy sinh liên quan đến biên bản xác nhận miễn trừ trách nhiệm này, đơn đăng kí hay sự tham gia vào các hoạt động, hay các mối quan hệ liên quan tới Đơn vị tổ chức sẽ được giải quyết theo luật pháp của Việt Nam.
23. Biên bản xác nhận miễn trừ trách nhiệm này có hiệu lực kể từ ngày được kí kết và vẫn có toàn bộ hiệu lực cho đến khi hoàn thành tất cả các hoạt động của Sự kiện. Trừ các điều khoản liên quan tới việc sử dụng hình ảnh, thông tin của tôi theo quy định tại Điều 14 và 15 của biên bản miễn trừ trách nhiệm này vẫn sẽ tiếp tục duy trì hiệu lực kể cả khi biên bản miễn trừ trách nhiệm này chấm dứt hoặc hết hạn.
24. Biên bản miễn trừ trách nhiệm này được lập song ngữ tiếng Anh và tiếng Việt, trong trường hợp có sự mâu thuẫn giữa hai ngôn ngữ thì bản tiếng Việt sẽ được ưu tiên áp dụng.

PHẦN DÀNH CHO VẬN ĐỘNG VIÊN DƯỚI 18 TUỔI

Tôi là phụ huynh hoặc người giám hộ hợp pháp của (những) vận động viên tham gia Sự kiện được đăng ký thông tin dưới đây (“Vận động viên”) và thay mặt Vận động viên xác nhận những điều khoản trong biên bản miễn trừ trách nhiệm này. 

Theo đó, tôi đã đọc và hiểu rõ các điều khoản và điều kiện của biên bản miễn trừ trách nhiệm này và đồng ý cho phép Vận động viên tham gia Sự kiện. Tôi hiểu và đồng ý rằng tôi và Vận động viên sẽ chịu ràng buộc và sẽ tuân thủ theo những điều khoản trong Biên bản miễn trừ trách nhiệm trên đây.

The Inaugural Techcombank Ha Noi Marathon (“Event”)

Waiver of liability statement

By participating in the Event you will be assumed to have read and agreed to comply with the terms and conditions set out on the https://marathonhn.com website and within the event online registration system, whether you have signed this agreement or not.

These terms and conditions are supplementary to the terms and conditions set out on the Event online registration system.

I have read, acknowledged, agreed and volunteered to comply with terms and conditions as follows:

I agree to read and abide by the competitive rules adopted by the race sanctioning body, including any Event Producer’s Competition Rules, information in the athlete information guide and I agree that prior to participating in the Event I will inspect the race course, facilities, equipment, and areas to be used, and if I believe or become aware that any are unsafe, I will immediately advise the Event Producer;

My participation in the Event is based the discretion of the Event Producer after consider all my information and application, including this waiver of liability statement;

 I acknowledge and agree that it is my responsibility to determine whether I am sufficiently fit and healthy enough to safely participate in the Event, and I attest and certify that I am or will be sufficiently fit and physically trained to participate in the Event, which I elect to enter;

Event Producer contracts with individuals or organizers that are independent contractors (not its employees or agents) to provide some of the services and/or to conduct some of the activities participants will engage in. I understand and acknowledge that Event Producer does not supervise or control these independent contractors. In addition, it is accepted that activities take place on premises or at facilities not owned or controlled by Event Producer;

The information provided in this waiver of liability statement is not exhaustive, other unknown or unanticipated activities, inherent or other risks and outcomes may exist, and the organizer cannot assure my safety or eliminate all risks. Event Producer representatives are available should I have further questions about the activities or the associated risks;

 I shall respect the rights and values of every individual at the event including athletes, volunteers and arbitrators. I shall always act professionally and responsibly, respect language and actions, and shall not discriminate against any individual with differences in gender, personality, ethnicity, religion, capability;

 I also assume any and all other risks associated with participating in this Event, including but not limited to the risks of property, life, health that I may encounter during the participation in the Event. I agree that I will be participating in the Event at my own risk, that I am responsible for the risk of participation in the Event.

 I agree that in case of a conflict between application forms, agreements or any other documents signed by me and Event Producer and this waiver of liability statement, this waiver of liability statement shall prevail.

 I hereby consent to receive medical care and treatment that may be deemed advisable in the event of injury, accident or illness to me while participating in the Event by a medical director or any of its agents, employees, volunteers, affiliates and designees, a physician and/or hospital. If necessary, I authorize the Event Producer or any of its agents, employees, volunteers, affiliates and designees, any organizer or sponsor of the Event, or any Event volunteer, to consent to such medical care and treatment. I understand that this authorization is given in advance of any specific diagnosis, treatment based on my health situation. And is given to provide authority and power to render care which the above-mentioned may deem advisable in the exercise of the best judgment of the medical unit receiving treatment for me. I agree to be responsible and assume liability for any and all costs incurred as a result of my participation in the Event, including but not limited to, medical care and treatment, ambulance services, hospital stays, and physician and pharmaceutical goods and services. I agree to indemnify and hold harmless the Released Parties from all liability for such costs. I also understand that initial care may be given by members of the Event Producer, race staff, or volunteers while awaiting care by the medical director or any of its agents, employees, volunteers, affiliates and designees, a physician and/or hospital. I hereby consent to receive immediate care by any of these parties in the event of injury, accident or illness to me while participating in the Event.

I understand that the Event Producer reserves the right, in its sole and complete discretion, to deny entry, revoke the entry application of any applicant at any time, and/or to disqualify any individual from the Event. I expressly waive any claim for damages arising from the denial or revocation of any reason including but not limited health reasons, exclusion or personal emergencies. If my application is rejected or eliminated, I agree that the Event Producer will not be liable for any costs or damages incurred to me or my family outside the scope of the contest. In the event that the Event Producer rejects or eliminates me from the Event, the Event Producer will not refund any entry fees if I have provided incorrect information regarding eligibility to participate in the Event and/or in violation of any relevant provisions of this waiver of liability statement. If I want to withdraw from the event of the organizers, I must comply with the rule and the instructions posted on https://www.marathonhn.com. 

I acknowledge and agree that the Event Producer, in its sole discretion, may delay, modify, or cancel the Event or components of the event, if it believes the conditions on the race day are unsafe or otherwise unsuitable for the Event, and Event Producer may delay the Event for so long as such unsafe or unsuitable conditions apply. In the event the Event is delayed, modified, or cancelled  due to force majeure reasons including but not limited to acts of God or the elements including without limitation, wind, rough water, rain, hail, hurricane, tornado, earthquake, pandemic, etc.), acts of terrorism, fire, threatened or actual strike, labor difficulty, work stoppage, insurrection, war, public disaster (including but not limited to Covid-19), public health risks, flood, unavoidable casualty, race course conditions, or any other cause beyond the control of Event Producer, there shall be no refund of Event Producer’s entry fee or any other costs incurred in connection with the Event. 

 I understand and acknowledge that compulsory insurance for runners during the event may not cover personal injury, loss or destruction caused by me.

My registration shall not be transferred to other people or entities. The transfer or permission of others to participate in my name will result in the cancellation of the registration for no refund, insurance will be void and disqualification from participation in the events of the event organizer 

I hereby grant to the Event Producer, Event sponsors, the government the right, permission, and authority to take pictures, record videos, record audio and/or use my information including but not limited: my name, image, voice, and/or likeness, without any fee for Event promotion purpose including but not limited the media in any photographs, videotapes, CDs, DVDs, broadcast, telecast, podcast, webcast, recordings, motion pictures, commercial advertisement, promotion materials, and/or any other record of this Event for any purpose whatsoever. I acknowledge that all ownership and copyright rights in the information mentioned in this Article are owned by the Event Producer and I waive any right of inspection or consent related to this information. I understand and agree that my name, bib number and race results will be made public during and after the Event.

I consent to my name and my contact details being included on the event database. I agree to have my image and information appear in Event Producer’s related publications which including but not limited to a monthly newsletter and other promotional materials about upcoming events.

I agree that if I choose not to be included on the Event Producer event database I will still receive newsletters that relate to the Event in which I have registered. I also agree that it is my responsibility to obtain information and event up dates from the event website, https://www.marathonhn.com  (if applicable).

Event Producer may assign this Form to other entity/s or individual/s (“assignees”) at any time, and any such assignment will grant assignees the full rights and protections accorded in this Form.

I am fully responsible for the security of my personal possessions at the Event and the Event Producer will not be liable for any loss or damage to my personal property during my participation in the Event..

Event Producer is providing a recreational service within the meaning of the Vietnam Law and that Event Producer excludes any liability for the death, physical or mental injury (including the aggravation, acceleration or recurrence of such an injury), the contraction, aggravation or acceleration of a disease, the coming into existence the aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behavior, course of conduct or state of affairs in relation to a participant that is or may be harmful or disadvantageous to the participant or the community or may result in harm or disadvantage to the participant or the community.

Event Producer will not be responsible for matters related to the products, services, foods, drinks sold and served in Marathon Village.

I understand and agree that Event Producer has put enhanced health and safety measures in place due to the potential spread of COVID-19. I must follow all posted instructions while visiting any Event-related venue. I voluntarily assume all risks related to exposure to COVID-19.

Any dispute or claim/s I may have arising out of, relating to or in connection with this waiver of liability statement, my enrollment or participation in the activities, or any other aspect of my relationship with Event Producer shall be governed by the laws of Vietnam.

This waiver of liability statement is effective from the date signed and shall remain in full force and effect following completion of all activities of the Event. Except for the terms related to the use of images, my information according to the provisions of Articles 14 and 15 of this waiver of liability statement shall remain effect even if the waiver of liability statement terminates or expires.

This waiver of liability statement is made bilingual in English and Vietnamese, in case there is a conflict between the two languages, the Vietnamese version shall prevail.

SECTION FOR ATHLETES UNDER 18 YEARS OLD

I am the parent or legal guardian of the athlete/s who registered below (“Athlete”) and have confirmed the Waiver of liability statement for and on behalf of Athlete. 

Whereby, I have read and understand the terms and conditions of this waiver of liability statement and agree to allow Athlete to participate in the Event. I understand and agree that me and Athlete shall be bound and shall abide by the terms and conditions of this waiver of liability statement.
